TOGA has been a synonymous name in Sydney’s new development industry since its founding in the early 1960s. As one of the city’s most notable builder-developers, the company has left its mark with landmark projects across the Eastern Suburbs and all the way to Macquarie Park. A key philosophy for <a href="https://www.urban.com.au/developers/toga-group">TOGA</a> is fostering a sense of community within its apartment developments.

A prime example of TOGA’s approach is its recently completed Surry Hills mixed-use precinct, <a href="https://www.urban.com.au/buildings/surry-hills-village-redfern-6-14-baptist-street-redfern-nsw-2016">Surry Hills Village</a> (SHV).

The retail and dining precinct, Wunderlich Lane, on the ground level has already become one of the talk-of-the-town spots. TOGA handpicked the hospitality tenants for this destination at the corner of Crown Street, where Surry Hills meets Redfern. Among the standout venues are Regina La Pizzeria by the Lumi Dining Group, Island Radio by House Made Hospitality, and Olympus Dining—owned by the same team behind the renowned Apollo restaurants in Potts Point.

“We took a lot of inspiration from Boheme Bondi when planning SHV,” Falas says. “At Boheme, residents take the lift directly down to Harris Farm and Lulu. I’m sure those living at SHV are already enjoying the vibrant offerings at Wunderlich Lane—some of the best food and hospitality Sydney has to offer, right on their doorstep.”

There are only 122 apartments and townhouses in SHV, and most were snapped up quickly when the project first launched. Only a handful remain, with the penthouse recently selling for $7.375 million—one of the highest sales in the Surry Hills/Redfern area.

While SHV is a rare, once-in-a-decade opportunity—due to its unique size and location—TOGA’s placemaking efforts continue to be evident in its other developments across Sydney. The developer is currently working on The Kensington, located on Anzac Parade, where apartments sit above seven planned hospitality venues and retail stores, directly across from a light rail stop and within walking distance to the growing UNSW and Randwick health precinct.

“The site where The Kensington sits is more suited to a traditional shop-top housing development,” Falas says. “But with seven retail spaces, we’re giving back a lot of space, offering a diverse mix of amenities that residents will love.”

TOGA is selective in choosing retail tenants, often opting to lease spaces to hospitality operators rather than sell them.

"By retaining control of the retail offerings, we can ensure that our buyers have access to high-quality services,” says Falas. "We’re not interested in tacky convenience stores or laundromats; that doesn't elevate the living experience for our residents."

<a href="https://www.urban.com.au/new-apartments/the-kensington-147-151-anzac-parade-kensington">The Kensington</a>, being built by the iCIRT-rated DASCO, will feature 142 one, two, and three-bedroom apartments—particularly popular with those in the medical and academic fields due to its proximity to Randwick's health precinct and UNSW. Investors are also eyeing the apartments, knowing they’ll likely attract quality tenants from these sectors and see strong capital growth in a limited supply area.

Another development currently under construction is <a href="https://www.urban.com.au/new-apartments/macquarie-rise-122-herring-road-macquarie-park">Macquarie Rise</a> in <a href="https://www.urban.com.au/developments/macquarie-park-nsw-2113">Macquarie Park</a>, where TOGA has once again pushed boundaries with an activated ground plane that blends nature and landscaping with more doorstep amenities.

“We’re creating a Macquarie Rise Village—a village green at the base of three towers that will combine nature with increased convenience,” Falas explains. “There will be several retail spaces, handpicked by TOGA, as well as a softening of the streetscape on Herring Road with extensive lawns and alfresco spaces.”

With higher density compared to developments like SHV and The Kensington, Macquarie Rise is designed to offer an exclusive community experience. Club Rise will feature a heated pool set amid lush landscaping, a gym with a yoga room, a resident lounge with communal dining areas, a karaoke room, and a bookable private dining room.

TOGA’s community-building approach has expanded to <a href="https://www.urban.com.au/developments/marrickville-nsw-2204">Marrickville</a>, where they’ve recently completed <a href="https://www.urban.com.au/buildings/wicks-place-marrickville-186-victoria-road-marrickville">Wicks Place</a>—a development of 272 apartments above a cafe-centric precinct and a new green park, both of which are key features of the inner west’s culture.

Only a few one and two-bedroom apartments remain in the building, which is located in the Victoria Road Precinct. This area was recently rezoned by the Inner West Council, and several developers are now planning large mixed-use projects that will continue to transform the once industrial zone into a more vibrant community, comparable to the neighbouring Newtown.

Latent Defects Insurance (LDI) is a game-changer for anyone looking to purchase a brand-new or off-the-plan apartment in Australia. This insurance policy, which can only be taken out by developers or builders (not individual apartment owners), offers a 10-year warranty on new apartments. It covers the cost of fixing any structural defects that may arise in the building.

So far, LDI has seen strong adoption from developers, with companies like Deicorp, DASCO, and Urban Property Group using it to provide their buyers with added peace of mind when purchasing off-the-plan properties.

I recently had the opportunity to sit down with Corey Nugent, CEO of <a href="https://www.urban.com.au/news/resilience-latent-defects-insurance">Resilience Insurance</a>—Australia’s only provider of LDI policies—to discuss the ins and outs of the important coverage.

<h2>How has Latent Defects Insurance (LDI) been received since its introduction in Australia?</h2>

Latent Defects Insurance is a crucial component for the future of Australia’s built environment.

Also known as Decennial Liability Insurance, LDI has been part of the new development landscape in Europe and other regions for over seven decades. In countries like France, Italy, Spain and Finland, it is mandatory for all new buildings—whether residential or commercial—to carry LDI coverage.

Since its <a href="https://www.urban.com.au/expert-insights/buying/the-evolution-of-latent-defects-insurance-worldwide-and-its-nationwide-availability-in-australia">rollout in Australia</a>, LDI has been very well received by developers, lenders providing financing to those developers, and most importantly, by buyers. It has quickly become an essential tool in building trust and ensuring long-term security for all parties involved.

<h2>What happens when the building is completed?</h2>

Once the building is complete, buyers move in, and LDI is applied to their apartment, as well as the entire building structure, for a period of 10 years. This coverage not only offers peace of mind but can also increase the resale value of the property. Importantly, the policy stays with the apartment, not the owner.

So, if an off the plan buyer decides to sell within the first 10 years, the remaining coverage is transferred to the new owner.

<h2>How does LDI benefit developers?</h2>

Developers see several key benefits from Latent Defects Insurance. The most obvious is that it makes their project more attractive compared to others that don’t offer LDI. Many buyers are willing to pay more for the assurance that comes with LDI, and developers often see faster sales as a result. Research, including studies by Urban, shows that over 60 per cent of buyers are willing to pay an additional 1.5 per cent for LDI coverage. This premium often more than covers the cost of the policy for the developer.

Typically, developers pay about 1.5 per cent of the build cost for the policy. However, if they can secure a higher sale price on their apartments due to the added value of LDI, they end up profiting. Another benefit is the added appeal LDI gives to a development, positioning it as a more secure investment for potential buyers.

Finally, LDI provides developers with an <a href="https://www.urban.com.au/expert-insights/latent-defects-insurance-101-what-is-the-technical-inspection-service-tis-program">extra layer of protection through the Technical Inspection Service (TIS)</a>. This third-party oversight ensures quality control throughout the build, which could otherwise cost developers hundreds of thousands of dollars in additional personnel. The TIS helps catch potential issues early, preventing future liabilities.

While the insurance is designed to protect the buyer, it also safeguards the developer. Should any structural, waterproofing, weatherproofing or MEPS (mechanical, electrical or plumbing systems) issues arise, the developer is covered for out-of-pocket costs. Developers understand the importance of completing projects smoothly and moving on to the next one without lingering problems. Given the large number of trades involved in constructing new buildings, LDI offers significant peace of mind.

<h2>How does LDI benefit buyers?</h2>

In Sydney, past incidents like the Mascot and Opal Towers issues have left many buyers wary of off the plan purchases. While these events occurred over six years ago, they still <a href="https://www.urban.com.au/news/what-is-latent-defects-insurance-and-is-it-bringing-confidence-to-the-off-the-plan-apartment-market">impact buyer confidence today</a>. However, the new development market is much stronger now, with stricter checks and regulations in place. Ultimately, Latent Defects Insurance provides protection for all parties.

In rare extreme cases, where residents may need to vacate due to major defects, <a href="https://www.urban.com.au/expert-insights/building/the-advantages-of-first-resort-strict-liability-latent-defects-insurance-for-off-the-plan-property-buyers">LDI offers first-right protection</a>, ensuring buyers are financially covered. Thanks to the continuous inspections carried out by TIS throughout the construction process, such situations are unlikely to occur, but LDI is there as a safety net if they do.

Melbourne developer SMA Projects almost doesn't see itself as a developer.

"We feel like we're more of a lifestyle creator," <a href="https://www.urban.com.au/developers/sma-projects">SMA Projects</a> Founder Martin Strode says, adding that they want to create spaces that enhance the way people live, through clever design, architectural features, and prime location of their projects.

When the opportunity to secure the former Regent Theatre site in <a href="https://www.urban.com.au/developments/fitzroy-vic-3065">Fitzroy</a>, it allowed them to tick all three of those boxes.

"While the Regent Theatre is long gone, we had a head start in the design phase because we knew how we wanted the building to look before we even secured the site. We had a bit of a blueprint as to the architectural integrity of the sites former life, and how we could reimagine it into a 21st century apartment building," Strode says.

SMA called on&nbsp;<a href="https://www.urban.com.au/architects/hayball">Hayball</a>, who they have been collaborating with across several architecturally-significant developments over the past two decades, to draw inspiration from the theatre's Art Deco past, incorporating arched ceilings and period-inspired details.&nbsp;

The Art Deco influence is immediately evident, beginning with the streetscape and extending into the lobby. Curved walls, elegant pendant lighting, and custom-designed, 70s-inspired mirrors capture the essence of a bygone era.

It was important the apartment interiors followed the same style, so the brief to<a href="https://www.urban.com.au/interior-designers/studio-tate"> Studio Tate</a> was of a similar narrative.

While also wanting to be flexible and give buyers a level of customisation which SMA believes is incredibly important in off the plan purchasing, Studio Tate put together two distinct designs; the light and refined Classic Collection, influenced by Nordic minimalism, and the dramatic, moody Arthouse Collection, inspired by Fitzroy’s artistic edge.&nbsp;

SMA’s philosophy is that buildings are about more than just the apartments. They make a conscious effort to create spaces where residents can gather, always staying true to their core belief of making life easier for those who live there.

Crowning the nine-level building will be a 315 sqm rooftop which will act as a shared space for residents to gather, eat, drink, and take in uninterrupted views of the Melbourne skyline.

In response to the 2023 Victorian pet census, which revealed that nearly 60% of Victorian adults own pets—particularly dogs—SMA also incorporated a dedicated dog wash facility within the building. Johnston Street also serves as a convenient thoroughfare, connecting west to Abbotsford and east to Carlton. The 96 tram, located just five minutes from The Regent at the intersection of Johnston and Nicholson Streets, provides direct access through the CBD and all the way to St Kilda Beach.

The Regent Fitzroy: Where architecture and lifestyle combine

When the development team at Scion was offered the opportunity to acquire an apartment project in Lane Cove North that was half-built, they had to be sure they knew what they were getting in for.

It was the first time the developer, which has its own building arm, was taking over a building that had already commenced construction.

Their minds were set at ease instantly when they were told the development had Latent Defects Insurance and had undergone the technical inspection service program by reputable industry experts since commencement. Sebastian Jabbour, Director of Operations at Scion, says it gave the team confidence to take on the project.

“Because we weren’t the developer who had brought on Latent Defects Insurance, we weren’t fully aware of all the benefits that came with LDI,” Jabbour says.

“It was remarkable how thorough the building inspections by the Technical Inspection Service were. It meant we had a third party ratifying the part of the build process we weren’t a part of - which was really the driver in us getting involved in the project.”

Scion is approaching completion of The Sterling, the first development in Lane Cove North with LDI. The 50 one, two and three-bedroom apartments which start from $750,000.

Mirvac's third Melbourne parkside collaboration with acclaimed architecture firm Bates Smart is starting to come out of the ground.

Mirvac's inhouse construction team has installed two cranes on the Park Street site, after completing demolition and excavating the two levels of basement car park last year. They will now work away throughout 2025 to build the structure, which will likely top out later this year.

The apartments so far have been the most popular with local owner-occupiers, who have been most attracted to Princes Park, home of Carlton Football Club, walking paths, sports grounds, and playgrounds, as well as the cafe culture in <a href="https://www.urban.com.au/developments/brunswick-vic">Brunswick</a> and the neighbouring <a href="https://www.urban.com.au/new-apartments/parkville-vic">Parkville</a>, <a href="https://www.urban.com.au/new-apartments/princes-hill-vic">Princes Hill</a>, and <a href="https://www.urban.com.au/new-apartments/carlton-vic">Carlton</a>.

There's been an influx of purchasers who are working in the medical industry in particular, given the development's proximity to several local hospitals. Prince &amp; Parade's location has also proven favourable for academics who work at highly prestigious local universities like Melbourne University and RMIT.

<h2>The Design</h2>

It's been cleverly designed so it reaches a height of nine levels to the north building on <a href="https://www.urban.com.au/new-apartments/5-9-brunswick-road-brunswick-east">Brunswick Road</a>, and five levels on the south-facing building on Park Street. The building will feature a rooftop terrace with views over the park and the rest of Melbourne. There will also be a resident lounge and dining room,a library, full wellness studio, and a ground-floor retail space, expected to be a cafe.

In line with Mirvac’s push to be net positive carbon by 2030, Prince &amp; Parade will be an all-electric building.

<h2>The Team</h2>

<a href="https://www.urban.com.au/developers/mirvac">Mirvac</a> has had parkside success previously when collaborating with <a href="https://www.urban.com.au/architects/bates-smart">Bates Smart</a> at their Fitzroy Gardens development <a href="https://www.urban.com.au/buildings/the-eastbourne-280-albert-street-east-melbourne">The Eastbourne</a>, which won the 2020 UDIA High Density Development Award. They've also worked together on The Melburnian on St Kilda Rd, which too was a UDIA Award winner.

Landscape architect Jack Merlo has handled the landscaping of Prince &amp; Parade. The rooftop terrace and central courtyards in particular will be enveloped in greenery. The courtyard will “provide a place of passive sanctuary, referencing the site's location opposite Princes Park,” Merlo said.
