Reservoir agent Robert Marshall gets licence suspension

Reservoir real estate agent Robert Marshall has had his licence suspended after failing to submit trust account records to Consumer Affairs Victoria.

The agent Robert James Marshall, who operated Partners Real Estate in Blake Street, Reservoir, had his licence suspended for failing to lodge trust account paperwork for six years.

It comes following repeated requests and warnings to the agent in Melbourne's northern suburbs.

“The rules on trust accounts exist to protect Victorians who are often making one of the biggest purchases of their lives – their homes,” the acting director of Consumer Affairs Victoria, Phil D’Adamo said.

The tribunal found Mr Marshall had contravened the Estate Agents Act 1980 by failing to:

  • have trust accounts audited within three months after 30 June each year
  • keep signed copies of audit reports and make them available upon demand
  • provide documents and answer questions as required.

The tribunal imposed a condition on Mr Marshall’s licence to stop him receiving trust money or opening, operating or maintaining a trust account.

He will also have his licence cancelled if he fails to lodge all outstanding audit reports and accounts with Consumer Affairs Victoria by 30 June 2013.
