NSW Planning Minister Rob Stokes has signalled the state government was set to clarify its position on SEPP 65.

It follows confusion on the expected minimum size of Sydney apartments following a Land & Environment Court judgement on a Botany residential development site.

That clarity could come from the government as early as next month.

"The amended policy (SEPP 65) will be released shortly and it will provide certainty about minimum apartment sizes," Stokes told The Australian Financial Review.

Clarity on SEPP 65, introduced in 2002, has been sought by the development industry.
