Wollongong estate agents to appeal jail sentence over $1.4 million misappropriation of client funds

Illawarra-based husband and wife estate agents Roger and Gordana Ocvirk have appealed a 12 month jail sentence imposed on them after pleading guilty to misappropriating $1.4 million of clients founds.

They admitted to misappropriating $1.2 million from strata company Strata Decisions Wollongong and $198,708 from real estate agency Dougmal Harcourts Warilla between August 2010 and January 2012, reported the Illawarra Mercury.

Gordana Ocvirk had previously pleaded guilty in Wollongong Local Court to two charges of failing to account for the money and one of failing to properly supervise Strata Decisions.

Roger Ocvirk pleaded guilty to the same three charges last week.

The couple used the trust account funds to try and keep their business from failing and planned to pay it back, said magistrate McGowan in his judgement.

The Ocvirks were released on bail pending their appeal in the District Court.
