Horizon, Darlinghurst pet ban ruled unconscionable by NCAT

The no-pet ban in Darlinghurst's landmark Horizon tower has potentially been overturned.

The NSW Civil and Administrative Tribunal (NCAT) ruled the ban should be scrapped immediately.

It has been there, and strictly enforced, since the building's off the plan inception.

It had been a four and a half year campaign by a dog owner who had moved in to the block with her miniature schnauzer Angus in 2015.

The by-law was been described as "harsh, unconscionable and oppressive" by NCAT senior member Gregory Burton.

He has ordered the owners corporation “promptly to do all acts necessary to record the removal of bylaw 14”.

Architect Mark Broadley, the current chair of Horizon's Owners' Corporation, isn't sure whether Horizon will challenge the decision.

He says it will be up to the owners, he told Nine Entertainment.

Last month the nearby Elan building saw its no-pet policy overruled by NCAT with the body corporate indicating would challenge the decision.
